NOTICE OF AGENCY ACTION

The Florida Department of Environmental Protection (“Department”) gives notice of issuance of a combined environmental resource permit (“Permit”), confirming regulatory, proprietary, and federal authorization, to Scott Mandel at 2732 Southeast County Road 21-B, Melrose, Florida 32666, Section 35, Township 8 South, Range 22 East, Bradford County, for the construction  of a 164’ long single family dock, with two boat slips and a second story observation platform, preempting 1979.5 sq. ft. of sovereign submerged land within Lake Santa Fe, Alachua County, Florida. The Department’s File Number for this authorization is 04-0290349-003-EG. This action is final and effective on the date filed with the Clerk of the Department unless a petition for an administrative hearing is timely filed under Sections 120.569 and 120.57, F.S., before the deadline for filing a petition. On the filing of a timely and sufficient petition, this action will not be final and effective until further order of the Department. Because the administrative hearing process is designed to formulate final agency action, the hearing process may result in a modification of the agency action or even denial of the application.

Petition for Administrative Hearing 

A person whose substantial interests are affected by the Department’s action may petition for an administrative proceeding (hearing) under Sections 120.569 and 120.57, F.S. Pursuant to Rules 28-106.201 and 28-106.301, F.A.C., a petition for an administrative hearing must contain the following information:

a) The name and address of each agency affected and each agency’s file or identification number, if known;

f) A statement of the specific rules or statutes that the petitioner contends require reversal or modification of the agency’s proposed action, including an explanation of how the alleged facts relate to the specific rules or statutes; and

g) A statement of the relief sought by the petitioner, stating precisely the action that the petitioner wishes the agency to take with respect to the agency’s proposed action.

The petition must be filed (received by the Clerk) in the Office of General Counsel of the Department at 3900 Commonwealth Boulevard, Mail Station 35, Tallahassee, Florida 32399-3000, or via electronic correspondence at [email protected] Also, a copy of the petition shall be mailed to the applicant at the address indicated above at the time of filing.

Time Period for Filing a Petition

In accordance with Rule 62-110.106(3), F.A.C., petitions for an administrative hearing by the applicant and persons entitled to written notice under Section 120.60(3), F.S., must be filed within 21 days of receipt of this written notice. Petitions filed by any persons other than the applicant, and other than those entitled to written notice under Section 120.60(3), F.S., must be filed within 21 days of publication of the notice or within 21 days of receipt of the written notice, whichever occurs first. You cannot justifiably rely on the finality of this decision unless notice of this decision and the right of substantially affected persons to challenge this decision has been duly published or otherwise provided to all persons substantially affected by the decision. While you are not required to publish notice of this action, you may elect to do so pursuant Rule 62110.106(10)(a).

The failure to file a petition within the appropriate time period shall constitute a waiver of that person’s right to request an administrative determination (hearing) under Sections 120.569 and 120.57, F.S., or to intervene in this proceeding and participate as a party to it. Any subsequent intervention (in a proceeding initiated by another party) will be only at the discretion of the presiding officer upon the filing of a motion in compliance with Rule 28-106.205, F.A.C. If you do not publish notice of this action, this waiver will not apply to persons who have not received written notice of this action.

Extension of Time 

Under Rule 62-110.106(4), F.A.C., a person whose substantial interests are affected by the Department’s action may also request an extension of time to file a petition for an administrative hearing. The Department may, for good cause shown, grant the request for an extension of time. Requests for extension of time must be filed with the Office of General Counsel of the Department at 3900 Commonwealth Boulevard, Mail Station 35, Tallahassee, Florida 32399-3000, or via electronic correspondence at [email protected] before the deadline for filing a petition for an administrative hearing. A timely request for extension of time shall toll the running of the time period for filing a petition until the request is acted upon.

Mediation  

Mediation is not available in this proceeding.

FLAWAC Review 

The applicant, or any party within the meaning of Section 373.114(1)(a) or 373.4275, F.S., may also seek appellate review of this order before the Land and Water Adjudicatory Commission under Section 373.114(1) or 373.4275, F.S. Requests for review before the Land and Water Adjudicatory Commission must be filed with the Secretary of the Commission and served on the Department within 20 days from the date when this order is filed with the Clerk of the Department.

Judicial Review 

Once this decision becomes final, any party to this action has the right to seek judicial review pursuant to Section 120.68, F.S., by filing a Notice of Appeal pursuant to Florida Rules of Appellate Procedure 9.110 and 9.190 with the Clerk of the Department in the Office of General Counsel (Station #35, 3900 Commonwealth Boulevard, Tallahassee, Florida 32399-3000) and by filing a copy of the Notice of Appeal accompanied by the applicable filing fees with the appropriate district court of appeal. Applicant: The applicant for this project is West Fraser, Inc. The applicant’s responsible official and mailing

address are: Joshua Crawford, General Manager, West Fraser, Inc., West Fraser Lake Butler Lumber Division, 9022 Southeast 186th Place, Lake Butler, Florida, 32054.

Facility Location: The applicant operates the existing West Fraser Lake Butler Lumber Division facility, which is located in Union County at 9022 Southeast 186th Place, Lake Butler, Florida.

Project: The applicant applied on January 18, 2022 to the Department for a Title V air operation permit renewal. This is a renewal of Title V Air Operation Permit No. 1250005-010-AV. The existing facility consists of several pieces of equipment used to process wood into chips and lumber. Equipment includes: a log

debarker, saw, chipper, sorter, planer, cyclones, drying kilns, and a hammermill. Southern pine logs are debarked, sawed and then dried in the kilns. The dried lumber is then planed, trimmed, and graded prior to shipment. The facility production is 130,000 MBF/year with the capacity of each kiln averaging approximately 43,333 MBF/year. Emissions from the facility include volatile organic compounds, particulate matter, and oxides of nitrogen. The emissions from the three direct fired kilns are uncontrolled.

Permitting Authority: Applications for Title V air operation permits are subject to review in accordance with the provisions of Chapter 403, Florida Statutes (F.S.) and Chapters 62-4, 62-210 and 62-213, of the Florida

Administrative Code (F.A.C.). The proposed project is not exempt from air permitting requirements and a Title

V air operation permit is required to operate the facility. The Northeast District Office is the Permitting Authority responsible for making a permit determination for this project. Notice of Intent to Issue Permit: The Permitting Authority gives notice of its intent to issue a renewed Title V air operation permit to the applicant for the project described above. The applicant has provided reasonable assurance that continued operation of the existing equipment will not adversely impact air quality and that the project will comply with all appropriate provisions of Chapters 62-4, 62-204, 62-210, 62-212, 62-213, 62-296 and 62-297, F.A.C. The Permitting Authority will issue a proposed permit and subsequent final permit in accordance with the conditions of the draft/proposed permit unless a response received in accordance with the following procedures results in a different decision or a significant change of terms or conditions.

Comments: The Permitting Authority will accept written comments concerning the draft/proposed Title V air operation permit for a period of 30 days from the date of publication of the Public Notice. Written comments

must be received by the close of business (5:00 p.m.), on or before the end of this 30-day period by the

Permitting Authority at the above address. As part of his or her comments, any person may also request that the

Permitting Authority hold a public meeting on this permitting action. If the Permitting Authority determines there is sufficient interest for a public meeting, it will publish notice of the time, date, and location in the Florida

Administrative Register (FAR). If a public meeting is requested within the 30-day comment period and (Public  conducted by the Permitting Authority, any oral and written comments received during the public meeting will

also be considered by the Permitting Authority. If timely received written comments or comments received at a

public meeting result in a significant change to the draft permit, the Permitting Authority shall issue a revised draft/proposed permit and require, if applicable, another Public Notice. Petitions: A person whose substantial interests are affected by the proposed permitting decision may petition for an administrative hearing in accordance with Sections 120.569 and 120.57, F.S. A petition that does not dispute the material facts upon which the Permitting Authority’s action is based shall state that no such facts are in dispute and otherwise shall contain the same information as set forth above, as required by Rule 28-106.301, F.A.C.

Because the administrative hearing process is designed to formulate final agency action, the filing of a petition means that the Permitting Authority’s final action may be different from the position taken by it in this written notice of Intent to Issue Air Permit. Persons whose substantial interests will be affected by any such final decision of the Permitting Authority on the application have the right to petition to become a party to the proceeding, in accordance with the requirements set forth above.

Extension of Time: Under Rule 62-110.106(4), F.A.C., a person whose substantial interests are affected by the Department’s action may also request an extension of time to file a petition for an administrative hearing. The Department may, for good cause shown, grant the request for an extension of time. Requests for extension of time must be filed with the Office of General Counsel of the Department at 3900 Commonwealth Boulevard, Mail Station 35, Tallahassee, Florida 32399-3000, or via electronic correspondence at Agency Clerk @dep.state.fl.us, before the deadline for filing a petition for an administrative hearing. A timely request for extension of time shall toll the running of the time period for filing a petition until the request is acted upon.

Mediation: Mediation is not available in this proceeding.

EPA Review: EPA has agreed to treat the draft/proposed Title V air operation permit as a proposed Title V air

operation permit and to perform its 45-day review provided by the law and regulations concurrently with the

public comment period, provided that the applicant also transmits an electronic copy of the required proof of

publication directly to EPA at the following email addresses: [email protected]. The final Title V air operation permit will be issued after the conclusion of the 45-day EPA review period so long as no adverse comments are received that result in a different decision or significant change of terms or conditions. Objections: Finally, pursuant to 42 United States Code (U.S.C.) Section 7661d(b)(1), to object to the issuance of any Title V air operation permit. Any

petition shall be based only on objections to the permit that were raised with reasonable specificity during the 30-day public comment period provided in the Public Notice, unless the petitioner demonstrates to the Administrator of the EPA that it was impracticable to raise such objections within the comment period or unless the grounds for such objection arose after the comment period. Filing of a petition with the Administrator of the EPA does not stay the effective date of any permit properly issued pursuant to the provisions of Chapter 62-213, F.A.C. This is to give notice that the City of Lawtey has submitted an application for a Community Development Block Grant (CDBG funds) to the Florida Department of Economic Opportunity (DEO).  The funding is provided by the U.S. Department of Housing and Urban Development (HUD) through CDBG Agreement No. IR018.

This notice is required by Section 2(a)(4) of Executive Order 11988 for Floodplain Management, and by Section 2(b) of Executive Order 11990 for the Protection of Wetlands, and is implemented by HUD Regulations found at 24 CFR 55.20(b) for the HUD action that is within and/or affects a floodplain or wetland.

Construction will be undertaken in the 100year floodplain and/or wetlands.  The City of Lawtey is interested in alternatives and public perceptions of possible adverse impacts that could result from the project as well as potential mitigation measures.  Proposed improvements which include the restoration of existing open ditch drainage which is located within the 100-year floodplain and/or wetlands.  The overall project scope as well as the portion of the project located within 100-year floodplain and/or wetlands includes: 

The City of Lawtey intends to use funds received from the Florida Department of Economic Opportunity’s Disaster Recovery (FDEO-DR) program to provide ditch restoration of Canal 1 (Along Jackson St. from its beginning at the City limits in the southeast to the City limits in the northwest), Canal 2 (along CR125 from the intersection of US301 and CR125 heading northeast along CR125 to the City limits), Sub-Canal A (along Monroe St. from the intersection of Monroe Street and Grove Street until its terminus at Canal 1), Sub-Canal B (along the platted portion of Olive Street from the intersection of Grove St and Olive Street northwest towards the intersection of Adams St and Olive Street).  Additionally, the City intends to use FDEO-DR funds for drainage improvements to the culvert crossing at Jones Lane and Linwood Avenue as well as the culvert crossing at Olive and Jackson Street.
