These notices shall satisfy two separate but related procedural requirements for activities to be undertaken by the City of Lawtey.
REQUEST FOR RELEASE OF FUNDS
On or about October 4, 2022 the City of Lawtey will submit a request to the Florida Department of Economic Opportunity (DEO) for the release of CommunityDevelopment Block Grant funds under Title I of the Housing and Community Development (HCD) Act of 1974, as amended, to undertake a project whichintends to provide ditch restoration of Canal 1 (Along Jackson St. from its beginning at the City limits in the southeast to the City limits in the northwest), Canal 2 (along CR125 from the intersection of US301 and CR125 heading northeast along CR125 to the City limits), Sub-Canal A (along Monroe St. from the intersection of Monroe Street and Grove Street until its terminus at Canal 1), Sub-Canal B (along the platted portion of Olive Street from the intersection of Grove St and Olive Street northwest towards the intersection of Adams St and Olive Street). Additionally, the City intends to use FDEO-DR funds for drainage improvements to the culvert crossing at Jones Lane and Linwood Avenue as well as the culvert crossing at Olive and Jackson Street. All facilities are currently in-place and operational. The estimated cost for the project is $867,600 of which all funds are being provided through CDBG Agreement IR018.
FINDING OF NO SIGNIFICANT IMPACT
The City of Lawtey has determined that the project will have no significant impact on the human environment. Therefore, an Environmental Impact Statementunder the National Environmental Policy Act of 1969 (NEPA) is not required. Additional project information is contained in the Environmental Review Record(ERR) on file at 2793 Lake Street, Lawtey, FL 32058 and may be examined or copied weekdays from 9:00am to 2:00pm.
PUBLIC COMMENTS
Written comments must be received by Lisa Harley, City Clerk in person at 2793 Lake Street, Lawtey, FL 32058 or mailed to PO Drawer G, Lawtey, FL 32058 on or before October 3, 2022 by 5:00pm. Comments may also be submitted by email at [email protected]. All comments must be received by October 3, 2022. Comments will be considered prior to the City of Lawtey requesting a release of funds. Comments should specify which notice they areaddressing.
RELEASE OF FUNDS
The City of Lawtey certifies to the Florida Department of Economic Opportunity and HUD that Jimmie Scott in his capacity as Mayor consents to accept thejurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilitieshave been satisfied. The State’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows the City of Lawtey to use the CDBG funds.
OBJECTIONS TO RELEASE OF FUNDS
DEO will accept objections to its release of funds and the City of Lawtey certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer ofthe City of Lawtey; (b) the City of Lawtey omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR part 58; (c) the grant recipient has committed funds or incurred costs not authorized by 24 CFR Part 58 before approval of a release of funds by the State; or (d) another Federalagency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality.Objections must be prepared and submitted in accordance with the required procedures at 24 CFR Part 58, Sec. 58.76 and shall be addressed to the Florida Department of Economic Opportunity, CDBG Program, MSC-400 107 East Madison Street, Tallahassee, FL 32399-6508. Potential objectors should contactthe City of Lawtey to verify the actual last day of the objection period.
