REQUEST FOR RELEASE OF FUNDS
On or about September 10, 2024, the City of Lake Butler will submit a request to the Florida Department of Commerce (FloridaCommerce) for the release of Community Development Block Grant – Mitigation (CDBG-MIT) funds under Title I of the Housing and Community Development (HCD) Act of 1974, as amended, to undertake a project known as #MT118 to make the following improvements:
Activities:
The City of Lake Butler, Florida has been awarded Three Million Five Hundred Nineteen Thousand Eight Hundred Eighty-Eight Dollars and Zero Cents ($3,519,888.00) in CDBG-MIT (Community Development Block Grant – Mitigation) funding to implement the Lake Butler Sanity Sewer Collection System Improvements Project. The scope of the project is to replace and/or rehabilitate six (6) existing sanitary sewer lift stations, including installation of six (6) emergency back-up electrical generators. In addition, the grant will also replace the existing Master Lift Station with a newly constructed master lift station with a new emergency back-up electrical generator on City-owned property located near the intersection of SE 11th Street and SE 5th Avenue, and construction of wastewater force mains serving all of the six (6) sanitary sewer lift stations and the master lift station is also included as part of the project. The initial funding request included the rehabilitation and/or replacement of the six (6) sanitary sewer lift stations and the installation of the six (6) emergency back-up generators. However, the grant award was $1,000,000 less than the initial amount requested. The City is actively seeking the shortfall funds. Should additional funding be secured or sufficient additional #MT118 funds become available, the scope of the project will be expanded to include the remaining lift stations, force mains, and back-up generators.
The proposed project activities and locations are:
The activity at Lift Station #1 (Water Works Lift Station) will be to install a new emergency electrical generator utilizing CDBG-MIT #MT118 funds. Lift Station #1 will be replaced with a new modern lift station and will be relocated approximately 200 feet west of the current location and constructed on the City-owned property located at the NW corner of SW 6th Avenue (SR 231) and SW 5th Street utilizing funding from CDBG-NR #22DB-OP-03-73-02-N06.
The activity at Lift Station #2 (Shaw’s Lift Station), utilizing CDBG-MIT #MT118 funds, is to install a new emergency electrical generator to serve the lift station. The lift station will be rehabilitated or replaced, if #MT118 funds are available. Lift Station #2 is located on the west side of SW 4th Place between SW 12th Street and SW 13th Street and will remain in its current location.
If sufficient #MT118 funds are available, the proposed activity at Lift Station #3 (Car Wash Lift Station), the rehabilitation or replacement and relocation of Lift Station #3 will be carried out. Additionally, if sufficient funding is available, a new emergency back-up electrical generator will be installed adjacent to Lift Station #3. Lift Station #3 is currently located at the southwest corner of SE 8th Street and SE 7th Avenue and, if funding is available, will be relocated to an easement approximately 70 feet south of the current location of the lift station on SE 7th Avenue.
If sufficient #MT118 funding is available, the activity at Lift Station #4 (Cal’s Lift Station) to be carried out is the rehabilitation or replacement and relocation of Lift Station #4, including the installation of a new emergency back-up electrical generator. Lift Station #4 is currently located at the northwest corner of SE 4thStreet and SE 6th Avenue and, if sufficient funding is available, the Lift Station #4 will be relocated to a city-owned property approximately 200 feet north of its current location on SE 6th Avenue.
The activity to be carried out at Lift Station #5 (Pudden Lift Station), is to rehabilitate or replace and relocate Lift Station #5, and to install a new emergency electrical generator at Lift Station #5 utilizing CDBG-MIT #MT118 funds. Lift Station #5 is currently located on the northeast corner of SW 8th Place and SW 1st Way and will be relocated approximately 400 feet east of its current location to the northwest corner parcel of city-owned property located at SW 7th Avenue and SW 1st Way using CDBG-MIT #MT118 funds.
The activity to be carried out at Lift Station #6 (Jetts Lift Station) is to install an emergency electrical generator at Lift Station #6 utilizing CDBG-MIT #MT118 funds. Lift Station #6 is currently located on the west side of NW 7th Avenue between W Main Street (Hwy 100) and NW 3rd Street and will be replaced, if funds are available, utilizing funding from CDBG-NR Grant #22DB-OP-03-73-02-N06. The relocation of Lift Station #6 is included as Unmet Need #1 in the CDBG-NR application. If funding is available, the existing lift station #6 will be replaced with a new modern lift station and relocated to a fenced-in island within Union County Housing Authority Property. CDBG-NR #22DB-OP-03-73-02-N06 funds will be utilized for the relocation and replacement of Lift Station #6 if sufficient funds are available; otherwise, #MT118 funds will be utilized to fund the replacement of Lift Station #6. The new Lift Station #6 location will be approximately 80 feet southwest of the current location of Lift Station #6.
The activity to be carried out at the Master Lift Station will be to relocate and replace the existing Master Lift Station with a new Master Lift Station. The existing Master Lift Station is currently located along SE 11th Street and will be relocated, utilizing CDBG-MIT #MT118 funding, approximately 100 feet east, on the same parcel of City-owned property. The existing emergency electrical generator serving the Master Lift Station will be replaced, utilizing CDBG-MIT #MT118 funding, with a new emergency electrical generator which will be placed adjacent to the new Master Lift Station location.
The construction, renovation or relocation of several existing sanitary sewer force main segments which will convey wastewater from the six (6) lift stations referenced herein as well as the Master Lift Station to the City’s Wastewater Treatment Facility. The sanitary sewer collection system is designed so that wastewater from all of the lift stations flow through the Master Lift Station and is then pumped to the Wastewater Treatment Facility.
None of the activities in Service Areas will be carried out within a floodplain or wetland.

FINDING OF NO SIGNIFICANT IMPACT
The City of Lake Butler has determined that the project will have no significant impact on the human environment. Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required. Additional project information is contained in the Environmental Review Record (ERR) on file at 200 SW 1st Street, Lake Butler, Florida 32054, and may be examined or copied from 8:00 A.M. to 5:00 P.M. Monday through Friday.
PUBLIC COMMENTS
Any individual, group, or agency may submit written comments on the ERR to Kimberly Hayes, City Manager, City of Lake Butler, 200 SW 1st Street, Lake Butler, Florida 32054. Comments may also be submitted via email at [email protected]. All comments must be received by September 9, 2024. Comments will be considered prior to the City of Lake Butler requesting a release of funds. Comments should specify which notice they are addressing.
RELEASE OF FUNDS
The City of Lake Butler certifies to FloridaCommerce and HUD that Melissa Hendrix, in her capacity as Mayor consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. FloridaCommerce’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows the City of Lake Butler to use the CDBG funds.
OBJECTIONS TO RELEASE OF FUNDS
FloridaCommerce will accept objections to its release of funds and the City of Lake Butler certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of the City of Lake Butler; (b) the City of Lake Butler has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR part 58; (c) the grant recipient has committed funds or incurred costs not authorized by 24 CFR Part 58 before approval of a release of funds by the State; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures at 24 CFR Part 58, Sec. 58.76 and shall be addressed to the Florida Department of Commerce, Office of Long-Term Resiliency at 107 East Madison Street, Tallahassee, FL 32399.
